MINUTES OF THE ORONO PLANNING COMMISSION MEETING <br />HELD APRIL 19, 1993 <br />ZONING FILE *1813 - CONT. <br />Mabusth noted if the house were destroyed, a lot area and width <br />variance would be needed to rebuild. <br />Bellows stated they are asking for the creation of something highly <br />irregular. <br />Kvhar noted, if approved, they would be responsible for the <br />creation of necessary documents. <br />Cohen inquired about exchanging land with the adjacent property <br />owner. <br />Niska arrived, and stated the neighbor was unwilling to consider, <br />in part because the land to the back of the property is more usable <br />to him <br />Mabusth said the easement area is 32.5 s.f., or a 7" encroachment. <br />Pat Brick ley, adjacent neighbor, said he was not totally in <br />opposition to the exchange of land, and Just thought the easement <br />was the easiest way to remedy the situation <br />Johnson stated he was not opposed to the easement, and felt either <br />way the lot line Is contrived. <br />Cohen reiterated <br />concerned with. <br />It is the precedent of the issue they are <br />It was moved by Cohen, seconded by Peterson, to recommend denial <br />of the easement request for Application #1813, Leonard Niska, <br />2304/2308 Shadywood Road, but to recommend approval of a lot line <br />rearrangement between the two properties, assuming both owners <br />agree to such. Ayes 5, nays 0. <br />(#4) #1818 RUSSELL LUND ESTATE, <br />905 TONKAWA ROAD > <br />PRELIMINARY SUBDIVISION - PUBLIC HEARING 8:25 - 8:40 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />Tracey Lund and Mark Gronberg were present. <br />Mabusth reviewed this is a two lot subdivision, and noted both lots <br />meet the 1 acre zoning standards of the LR-1B zoning district. The <br />existing shed on the proposed shared lot shall be removed. She <br />referred to past conditional use permit approval for independent <br />antenna structures, and suggested removal of such.
