5. <br />B <br />C. <br />The femovtl of mature trees on this steeply sloping land to the rear of the <br />residence would eliminate the buffer from the residence on Lot 8 to the <br />immediate south. <br />Spiuce tiees immediately noith of the proposed tennis court location <br />minimiyg impacting the surrounding neighborhood to the ncMth, east, and <br />west. <br />No outside lighting may be used for this tennis court. <br />The City Council has considered this application including the findings and <br />lecommendations of the Planning Commission, reports by City staff, comments <br />by the applkanls and the effect of the proposed variance on the health, safety and <br />welfue of die coauminity. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect trafHc conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the appUcanu, but is necessary to alleviate a <br />demonstrable hardship or difficulty; b necessary to preserve a substantial property <br />right of the applicants; and would te in keeping with the spirit and intent of the <br />Zoning Code and M • r <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City CouncU hereby <br />grants variances to the Municipal Zoning Code Section 10.03, Subdivbions 9 (D) and 14 <br />to permit the construction of a teunb court to be located 17’ from the street lot line and 33 in <br />front of the front line of the residence, subject to the following conditions: <br />1 The appHcant b required to submit a grading and drainage plan as well as clearly <br />fence off the future drainfield site prior to the bsuance of a building permit. <br />Page 2 of 5
