Special Assessments. <br />(a) Whenever a Lot and its Owner is separately respon­ <br />sible for maintenance or repair of any part of the Common Area, <br />the Association shall levy a "Special Assessment" against that <br />Lot and its Owner. <br />(b) Each Special Assessment shall be due and payable <br />in such installments as the Board shall determine, but no more <br />frequently than monthly and no less frequently than semi-annually <br />and in any event shall be fully paid within one year. <br />Section 8. Notice and Quorum for Any Action_Authorised <br />Under Sections 3 and 5. Written notice of any meeting called for <br />the purpose of taking any action authorized under Section 3 or 5 <br />of this Article shall be sent to all members not less than 30 <br />days, nor more than 60 days, in advance of the meeting. At the <br />first such meeting called, the presence of members or of proxies <br />entitled to cast a majority of all the votes of each class of <br />membership shall constitute a quorum. If the required quorum is <br />not present, another meeting may be called subject to the same <br />notice requirement, and the required quorum at the subsequent <br />meeting shall be one-half (1/2) of the required quorum at the <br />preceding meeting. No such subsequent meeting shall be held more <br />than 60 days following the preceding meeting. <br />Section 9. Uniform Rate of Assessment. All Assessments <br />shall be fixed at an equal rate for all Lots, except that Special <br />Assessments shall be levied against only those Lots and Owners <br />whom the Board determines (after notice and a reasonable <br />opportunity to be heard) to be responsible. <br />Section 10. Setbacks. <br />(a) The recorded plat of MEYERS WOODS public utility <br />and drainage easements have been dedicated along the perimeters <br />of all loti? (*"* certain lots? Within said easement areas <br />no houses or other improvements shall be built that would inter­ <br />fere with utilities or drainage. <br />(b) Ordinances of the City of Orono prohibit con­ <br />struction of buildings within the front 50 feet, rear 50 feet and <br />side 30 feet of each Lot. Said ordinances may be changed by the <br />City Council. For this purpose, front, rear and side yard set­ <br />backs are measured pursuant to municipal ordinances. <br />(c) In addition to the setbacks described in subsec­ <br />tions (a) and (b), no clearing, grading or construction shall be <br />conducted within the front 25 feet, rear 25 feet and side 10 feet <br />of each Lot. For this purpose, for each Lot front yard setbacks <br />are measured from the Lot's common boundaries with Outlot A, rear <br />yard setbac<^s are measured from the Lot's common boundaries with <br />Outlot B and side yard setbacks are measured from the Lot's com­ <br />mon boundaries with other Lots.
