This type of paving pattern appears quite consistent with the surrounding properties on Shadywood Road. Staff cannot remember a variance for hardcover being approved that was based solely on the need to provide <br />parking for many quests. Such temporary parking could be provided by <br />grassed areas on the property. Staff would suggest that in reviewing the <br />site plan (Exhibit P)* there is not enough paved backing-out area from the <br />garage and would suggest maybe expanding on that to allow greater <br />maneuverability. A minimum of 20' should be provided for at least a 20—22* <br />length extending from the garage. <br />The attached garage* a non-conforming structure* is located 4.7* off <br />the street right-of-way and approximately 2* from the side lot line to the <br />north. Applicant's claim that the garage is absolutely essential for <br />storage would indicate to those of us involved in the original application <br />that there was really no serious thought to the previous agreement, an <br />agreement that was set out in a formal resolution that was signed by the <br />applicants. The larger* Improved house and the garage would create a <br />cluttered and densely developed look in comparing current pattern of <br />develoixnent. <br />The storm door shelter referred to by applicant can be seen i' xtem A <br />on Exhibit P. If this access door to the house is essential and r a. not be <br />feasibly removed* then Planning Commission may consider allowx^.g the <br />structure to stay and may also ask for additional driveway to be removed. <br />Staff Recoamendation - <br />To deny applicant's request to retain the detached gare^ge within the <br />street yard and existing paving adjacent to Shadywood Road referred to <br />as driveway apron and to allow the storm door shelter to remain based on <br />the following findings: <br />1. Applicant participated throughout the entire review and received <br />notice of all final action culminating in the signing of a formal <br />resolution whereby applicant agreed to make the necessary removals. <br />2. The total variance of 43% hardcover within the 75-250' setback <br />area is excessive for this size property and would not be consistent <br />with previous Council action with similar applications. <br />3.
