The applicant haa reduced hardcover with the new proposal for the <br />inproveaents within the lakeahore yard ai^ within the 75-250* setback <br />B. The existing structures were renoved aa a result of a severe <br />atom that eroded the lakeahore bank and had nothing to do with the <br />laproper maintenance of the subject structures. <br />C. There have been no substantial changes in the code since 1575 <br />when the LR districts and lakeahore standards were established. <br />D. The City had approved siailar variances for the property in1970. rrj <br />B. The steep topography requires special consideration for the <br />residents of the property. <br />F. The applicant’s physical lialtations as documented by his <br />personal physician's report would prevent his full enjoyment of his <br />lakeahore property if the deck and shed were not restored to lakeahore yard. <br />The following conditions are also recoanended with the approval of this application: <br />1. Run-off from the roof of the shed must be directed away froa the <br />grade level of the retaining wall and drained to a drainage structure <br />already within the retaining wall substructure or via an Independent <br />drainage tile. This will prevent any undermining of the existing <br />retaining wall structure. <br />2. Plantings must be provided adjacent to each of the retaining wall <br />levels to provide the necessary screening and ground cover <br />atablisatior. <br />3. The applicant has agreed to resK>ve 157 s.f. of existing hardcover <br />within the 75-250* setback area.
