I <br />Memo - Section 10.41 <br />May 31. 1994 <br />Page 3 <br />• Subdivision 6 <br />This section adds a long list of allowable "accessory uses”. The B-2 Zone is the only <br />commercial or residential zone in Orono with no code allowance for accessory uses. <br />The planning Commission reviewed each proposed accessory use in the context that it <br />must be subsidiary to a pemucted use. No accessory use can exist unless a permitted use exists <br />on the property. One of the Planning Commission ’s primary concerns was that reasonable <br />accessory uses be allowed, and per the format of Orono ’s zoning code, uses not listed are not <br />allowed This resulted in a fairly long list of accessory uses which are relatively specific in <br />scope. It also resulted in careful review of those uses which should be ondition al rather than <br />accessory'. <br />• Subdivision 7 . ^ . u- <br />This section adds a list of conditional uses, including boat clubs, on-demand launching. <br />transient launching, chaner boat port-of-call. lake/lake structure maintenance base, and <br />snowmobile sales/service. Planning Commission found that each of these uses may be a <br />legitimate and reasonable activitv at a marina within the B-2 Zone under certain circumstances, <br />the common concern being adequate parking on the site. Note that all listed conditional uses <br />are proposed to be allowed only for marinas that are in compliance with the landscaping <br />and screening requirements. ......................... <br />Boat clubs were recognized as an alternative to individual boat ownership, that woula <br />expand the usage of a given boat with potential for increasing the percentage of boats in <br />use at the peak times. A limit on the percentage of boats at a given marina allowed for <br />boat club use was considered but not recommended. <br />- On-demand launching of customer owned boats stored on the business site requires not <br />only customer parking but boat/trailer storage space. It is perhaps unpredictable whether <br />LMCD will require licensing of non-rack storage space for such use. although LMCD <br />does currently license rack spaces for on-demand launching. Again, absent an intent by <br />the City to fiinher regulate numbers of boats on the lake, site congestion and provision <br />of adequate parking are the main concerns. u n ■> <br />Public transient boat launchin2 via a ramp has historically been addressed in the B-- <br />parking requirements (Subd. 8) but was never listed as a permitted or conditional use. <br />Adequate parking is the main concern, and Planning Commission suggests that Counc <br />be able to control the hours of operation. <br />. Use of a site for a charter boat port-of-cail relies on adequate parking primarily, but may <br />also have negative impacts on neighboring property owners* The proposed wor mg <br />allows the Cit\’ to place appropriate conditions on this use to protect the public interest. <br />- Planning Commission acknowledged that a lake/lake strucmre maintenance operations <br />base mav be a "necessary evil", providing a location for the less attractive but necessary <br />lake maintenance activities to occur. The wording allows Council to limit sue <br />operaiiom: at Council ’s discretion. u v,- r f <br />- Allowing snowmobile sales and service as a conditional use was e su jec o <br />considerable discussion by the Planning Commission and some marina operators.
