Water sunpiv imates. No docharge of dredged or fill material may occur in the pronmity of a pubbe water <br />supply intake except where the discharge is for repav of the public water supply intake structures or adjacent bank <br />stabilization. <br />2. Shellfish production. No discharge of dredged or fill material may occur in areas of concentrated shellfish <br />produaion. utyess the docharge d direaly related to a shellfish harvesting activuy authorized by nanonwide permii 4. <br />3. Suitable material No discharge of dredged or Till material may oondt of unsutuNe matenal (e.g.. trash, <br />debris, car bodies, etc) and niMerial discharged mutt be free from tobc poOutams m topdc arooums (see sectioo 307 of <br />the Clean Water Act). <br />4. Mitieation . Ddeharges of dredged or fill material mto waters of the United States must be miniinized or <br />avoided to the maximum extent praaicable at the prpjea site (i.e. on-site), unless the DE has apprm«d a <br />compensation mitigation plan for the speofic regulated aatvuy. <br />5. Soawninc areas . Discharges in spawning areas during spaw ning seasons must be avoided to the maxianim <br />extent practicable. <br />6. Obstruction of hieh ftaas . To the iWDomum extent practicable, ddeharges must not permanently resthet or <br />impede the panigc of norma l or expected high Om«s or cause the rdocatioo of the water (unless the primaiy purpose <br />of the fyi d to uod waters). <br />7. Adverse imcacts from impoundments. If the discharge creates an unpoundmeot of water, adverse jfnp»<v« oo <br />the aquatic system caused by the accelerated passage of water and/or the resinaion of its fltw shali be mioimiaed to <br />the maximum extent practicable. <br />8. WaterfcyM breedint areas . Discharges into breeding areas for migratory wMcrfowl must be avoided to the <br />maximum extent praaicable. <br />9. Retrxwal of temporary fills. Any temporary fills must be removed in their entirety and the afTeaed areas <br />returned to their preexisting elevstion.
