1*V <br />c.The propeity has been assessed one sewer unit and a sewer stub is <br />available at both Park Avenue and Tonkawa Road (CouMy Road 135). <br />D. There are no undeveloped <br />combining with the sub^andaid property <br />The City Council finds that the conditions existing on this property* are peculiar <br />to it and do not apply generally to other property in this zoning district: that <br />gnmting the variances would not adversely affiKt traffic conditions, light, air nor <br />pose a fue hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty ; is necessary to preserve a subsuntial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5.The City Council has considered this application including the findings and <br />recommendations of the Plannii^ Commission, repoits by City suff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants variances to Municipal 2^ning Code Section 10.24. Subdivision 5 (B) to permit <br />construction of a new residence on a property that docs not meet the area or width requirements <br />seeking approval of an 18,560 s.f. or 42.6% area variance and 40 ’ or 28.5% lot width variance, <br />subject to the following conditions: <br />The four properties shall be legally combined prior to the City’s issuance of a <br />building permit. <br />2.All future development shall be subject to the standards of the LR-IB Zoning <br />District and Shoreland Regulations of the City. <br />Per Section ’0.03, Subdivision 10, the lot is classified as a through lot a,;d all <br />accessory structure^ will require a conditional use permit. <br />Resolve of access/tumaround requirement <br />Page 2 of 4 <br />-jii-_ » ... . .r .
