■J«immw-m&\.mdWv"'i' *“! <br />* 'sIS*' <br />iiif.'.'ii <br />% "-xm <br />am <br />,ii <br />'■M" <br />f- <br />TO; <br />FROM: <br />DATE: <br />Mayor and City Council <br />Ron Moorsc, City Administrator <br />January 19. 1994 <br />SUBJECT: Use of Drug Forfeiture Funds <br />OigjkgisuQd <br />Sute law allows the police to seize money and property that is related to violations of drug laws. <br />When the Court awards the money to the police^ the County Attorney receives 20%, the Slate <br />receives 10% and the police department may retoin 70% to be used for srecific law enforcement <br />purposes. <br />The money may be used as "buy money" for additional enforcement, it may used to pay salaries <br />for extra drug enforcemem, it may be used for other dmg enforcemem or drug abuse prevention <br />efforts, or it may be used for other general law enforcement purposes. <br />During the past two years the only drug nwney used by the police departmeitt has been for Itay <br />money" for drug dealing investigation. The current balar« in the drug forfeiture fundis <br />$10,398.58. An additioiud $4,489.10 will be added to this fund in the first part of 1994, <br />bringing the total to 514,887.68. <br />A policy and procedure is needed to provide guidelines for how the drug forfeiture money may <br />be used and how its use is authorized. <br />Proposed Poliev and Procedure Reyarding the Use of Drug ForfcittOT pOTlfa <br />Policy: Drug forfeiture funds may be used for law enforcement purposes including; "buy <br />money" for drug investigation, expenses related to extra drug enforceriient such as police officer <br />salaries, other drug enforcement or drug abuse prevention efforts, minor capital items that are <br />beyond the funding able to be provided through the regular budget, and other law enforcement <br />related purposes. <br />Procedure: In the case of "buy money" for drug investigations, drug forfeiture funds may ^ <br />used at the discretion of the Police Chief In the case of all other uses, the ^ <br />expenditure of drug forfeimre ftinds must be approved by the City Administrator and authorized <br />by the City Council. <br />Council Action Requested - Motion to approve the proposed policy and procedure regardii^ the <br />expenditure of drug forfeiture money.
