i'- <br />A RESOLUTION DENYING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.27, SUBDIVISION 3 (A) <br />FILE #1971 <br />^ V.! <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, Brian A. Kipfer and Greg H. Sargent, (hereinafter "the Applicants") <br />are the owners of the property located at 320 Tumham Road within the City of Orono <br />(hereinafter "City") and legally described as: <br />Lots 1 and 2. Block 1, Chippewa Third Addition. Hennepin County, Minnesota <br />(hereinafter "the Property"); and <br />WHEREAS, on September 19, 1994 the Applicants applied to the City of Orono <br />requesting the City issue a building permit for certain year round living area expansions within <br />a detached garage; and <br />WHEREAS, the Planning Commission in consideration of the Applicants’ <br />request, reviewed the potential for easy conversion of the expanded area as an independent <br />residential unit or guest house, and act^ upon such request for a conditional use permit, as <br />though such request included such use; and <br />WHEREAS, the City Council of Orono (hereinafter "Council") has considered <br />this application including written reports by the City staff, the unanimous recommendation of <br />the Plaiming Conunission, the comments and written statements of the applicants. <br />NOW, THEREFORE, BE IT RESOLVED that Council hereby denies a <br />conditional use permit based on one or more of the following findings of fact: <br />h <br />Page 1 of 8 <br />jc
