r <br />Request for Council Action continued <br />page 4 of 5 <br />October 6, 1994 <br />Zoning File #1967 _________ <br />Hennepin Public Works Department Comments <br />Hennepin DOT has indicated approval of Outlot B as an access location. They also request <br />additional right-of-way to total 40’ from the centerline of Bayside Road. It would be <br />inconsistent with past City practice to require this on Bayside Road which is defined in the <br />Comprehensive Plan as a "collecter" street requiring only 30-33’ either side of centerline. Staff <br />recommends no additional right-of-way be required at this time. <br />Summary of Issues <br />1. Will Council accept the agreement in lieu of including Geffre’s property in the plat to <br />create a continuous access outlot corridor to Outlot C? <br />2. Will Council accept the concept of making the remaining 14 acres an outlot with no <br />development (not even one house) allowed until it is replatted or granted individual <br />buildability in the future? Council may wish to confirm applicant’s intent for proceeding <br />with replatting Outlot C in the next year with or without the White property. <br />Options for Action <br />1. Approve per the findings and conditions of the preliminary plat approval resolution <br />attached. <br />2. Refer back to Planning Commission for ftir»her review. <br />3. Direct staff to draft a resolution of denial, stating reasons. <br />4. Table, requesting further information (specify). <br />5.Other. <br />Staff Recommendation <br />In recognition of Planning Commission’s intent in recommending denial, staff has prepared a <br />resolution for preliminary plat approval incorporating applicant’s proposed preliminary plat and <br />agreement as presented. While staff wo Id prefer the inclusion of the (^ffre property to create <br />a complete outlot corridor to Outlot iie agreement appears to eliminate foreseeable access <br />issues as long as its term "replatted in mildable parcels" can be constated as including the <br />mere revision of Outlot C to single builuable lot status. If not, then language of the agre<^ent <br />should be revised to do so, or the Geffre property should be included in the plat and the <br />triangular outlot created.
