Vote: ____ayes. <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE NO. 1%3 <br />WHEREAS, James and Camille Farley are the owners of, and Engen & K(»zojed <br />& Associates, Inc. (hereinafter "the applicants) have an interest in the property located ct 15 <br />Orono Orchard South within the Ciiy of Orono (hereinafter "City") and legally described as <br />follows: <br />That part of the northwest quarter of the northwest quarter of I'ection 2, <br />Towni^p 117, Range 23, which lies northerly of the Luce Line Trail, Hennepin <br />County, Minnesota (also known as Property Identification Number 02-117-23 22 <br />>2) (hereinafter "the property"); and <br />WHEREAS, the a|!^licants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.28, Subdivision 5 (B) to permit the construction of a single family <br />residence on a lot 80’ in width in the RR-IB zoning district where required lot width is 200’. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1963. <br />2.The property is located in the RR-IB Single Family Rural Residential Zoning <br />District. <br />3.The Orono Planning Commission reviewed this application on September 19, <br />1994 and recommended approval of the proposed variance based upon the <br />following findings: <br />A. The shape of the property does not allow conformity to the City of <br />Orono ’s 20C ’ frontage requirement. The lot is triangular in shape and is <br />approximately 80’ in width at the 50’ front setback; and ranging from <br />110’ to 150’ in width at the proposed building site which is located <br />approximately 130 ’ from the front lot line. <br />Page 1 of 5
