CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />approves a setback variance of 48 ’ or 64% for the lakeside two story addition and upper level <br />deck and a hardcover variance within the 0-75’ setback area of 3,195 s.f. or 10.7% subject to <br />the following conditions: <br />¥ <br />1. <br />4. <br />5. <br />6. <br />Upon application for a building permit, applicants must provide an updated <br />survey showing location of all existing and proposed improvements to be <br />accompanied by a detailed grading and drainage plan. If it is found that iicw <br />addition will encroach any closer to lagoon than existing structure, applicants will <br />be required to file an amended variance q>plication with both the City and DNR. <br />All landscape areas underlain with plastic shall be removed prior to the footing <br />inspection for the proposed new construction. <br />Applicants to provide necessary erosion control along the shoreline of the pond <br />and wherever deemed necessary by the Orono Building staff prior to any land <br />alterations on this property. <br />Applicants have agreed to replant specific manire evergreens to be removed as <br />a result of these improvements. Applicants have submitted a site plan indict.ting <br />existing and proposed plantings in the 0-75’ setback zone included as page 6 of <br />this resolution. Plantings are to be completed prior to the final inspection for the <br />new construction by the Orono Building Department. <br />Authorities granted by this variance run with the property not with the applicants, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (September 12, 1995). <br />Violation of or non-compliance with any of the terms and con Uions of this <br />resolution shall constimte a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />Page 3 of 6
