Memo - Section 10.41 <br />May 31. 1994 <br />Page 5 <br />Item H is a notation that styrofoam dock flotation has been prohibited. <br />Item I separates gasoline storage language from dr>' stack requirements. <br />Item K is intended to set reasonable limits on rummer and winter on-land boat density, <br />by requiring development of a site plan for boat storage while maintaining appropriate <br />ingress egress emergency access to this site while maintaining adequate parking. <br />Inherent in the proposed wording is that the marina operator will deal w ith an envelope <br />rather than a specific number of allowed boats, since regulating boats by number rather <br />than location has generally not been effective in the past. <br />• Subdivision 12 <br />There are no proposed changes in area, height, lot width and yard requirements, since <br />Planning Commission chose to not reduce the standards for existing mannas. After much <br />discussion. Planning Commission concluded that the variance method for marina upgrades has <br />been an effective control and that reducing standards to those which most existing marinas could <br />meet or approach, would probably not provide a significant incentive for them to attempt <br />upgrades, since the variance process would likely stiU be needed under a relaxed set of <br />standards. <br />* Subdivision 13 <br />This section merely adds references to the Shoreland Management code requirements. <br />• Subdivision 14 <br />This section adds language requiring site and drainage plans upon any application <br />(subdivision/variance/CUP/building permit) and gives the City authority to require construction <br />of storm water control facilities. It adds shoreland management and flo<^ plain management <br />regulations to those codes with which changes in grade must be in compliance. <br />• Subdivision 15 . . - <br />This section updates the reference to LMCD Ordinances regarding regulation ot <br />structures in the lake. The current B-2 Code references LMCD Ordinance No. 1 which has been <br />superseded by Chapter U of the LMCD code. Planning Conunission noted that without <br />reference to LMCD’s code, the City would have no ordinance regulating docks. <br />• Subdivision 17 . • j i • <br />In this section, the current code allows by variance a four year installation and planting <br />period for required landscaping. Staning in 1975. such variance was allowed to any applicant <br />that agreed to a four year plan and "otherwise met all ot the provisions of this chapter . Smee <br />none of the existing marinas have ever met all of the provisions of this chapter, that requirement <br />is proposed to be dropped. The detailed landscape plan required is proposed to Prov ‘^some <br />winter screening which was not in the code previously, and sets a new initiation date of to r <br />1, 1994.
