M <br />k <br />CITY of ORONO <br />RESOLLTION OF THE CITY COUNCIL <br />NO. 8 3 8 g_____ <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.25. Subdivisions 6 (B) to permit the <br />construction of 10 ’ x 28’6" entrv addition to the northwest side of the existmg residence <br />requiring approval of a 3’3- or 33% side setback variance subject to the following conditions: <br />1.Applicant is hereby placed on notice that if plastic or geotechnic fabric is found <br />beneath landscape areas totalling approximately 18.5% in area that the existence <br />of such would be in violation of the conditions of approval of this variance and <br />will require the immediate removal. <br />2.Authorities granted by this variance run with the property not with the applicant, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (February 14, 1995). <br />3.Violation of or non-compliance with any of the terms and conditions of tWs <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />4.The undersigned applicant has read, understood and hereby agrees to the terms <br />of this resolution and on behalf of herself, her heirs, successors and assigr^, <br />hereby agrees to the recording of this resolution in the cham of title of the <br />property. <br />Page 3 of 5 <br />Mas 1 <br />> I mTi iMI II
