c <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE #1955 <br />WHEREAS, Andrew J. McDermott III (hereinafter The applicant") is owner of <br />the property located at 2702 Walters Port Lane within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />Lot 1, Block 1; Outlot 2, together with a nonexclusive easement for ingress and egress <br />over Outlots 1 and 3, all in Walters Port, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, th'* applicant has applied to the City for a variance to Municipal <br />Zoning Code Section 10.24, Subdivision 5 (B) to permit the construction of a screen porch <br />above an existing upper level deck, such porch to be located 34 ’ from the front lot line w'here <br />a 35’ setback is normally required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />1. <br />2. <br />3. <br />FINDINGS <br />Tliis application was reviewed as Zoning File #1955. <br />The property is located in the LR-IB, Single Family Lakeshore Residential <br />Zoning District. <br />The Orono Plamiing Commission reviewed this application on August 15, 1994, <br />and recommended approval of the proposed variance based upon the following <br />findings: <br />Pace 1 of 5
