The second residential structure has e.xisted on the property for over 40 <br />years. <br />d The City has received no negative comments from the adjacent residential <br />properties that would receive the most impact from the intensification m <br />use of the strucmre. <br />e The applicanc has advised in writing that the smicnire shall be used solely <br />for hUguests or visiting members of his family and shall never be used <br />for rental purposes. <br />5 The Citv Council finds that the conditions existing on this property are peculiar <br />to it anil do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect trattic conditions, lig t. air no <br />nose a Tire hazard or other danger to neighboring properties, would not merely <br />wrve as a convenience to the applicant, but is necessary to J <br />demonstrable hardship or difficulty; is necessary to preserve a substantial propeity <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />6 The City Council finds that granting a conditional use permit to allow a guest <br />hou.'^e use will not be detrimental to the health, safety or pneral welfare of the <br />public, would not adversely affect light, air nor pose a tire hazard or other danger <br />to neighboring properties, nor will it depreciate surrounding <br />that the proposed level of use of the property will be <br />and objectives of the Zoning Code and Comprehensive Plan of the City. <br />7 The City Council has considered this application including the <br />SommLaiions of ihc Planning Commission, reports by “""’X <br />by the applicants and other parties and the effect of the proposed vanance on the <br />health, safety and welfare of the community. <br />Pace 2 of 5 <br />W
