draft
MINUTES OF THE PARK COXLMISSION MEETING OF JULY 5, 1994
f
(#6) OTHER BUSINESS
While mentioned a recent Supreme Court decision regarding the taking of public property for
a bike trail and protection of easements and wetlands by a City. Because of similarities with the
bike trail, the case could have ramifications for Orono at some fuoire time. Chair Flint felt it
would be difficult to predict the significance of the case and noted it was a decision in
connection with a building permit not a subdivision approval. As a condition to the building
permit, it was required that the City give a trail easement and it was held unreasonable in that
circumstance.
White was also concerned with another issue regarding the Metropolitan CouncU’s initiative to
push fair share of open housing which will impact every community in the metropolitan area at
some point. Cities cannot put barriers in the way of public housing. The City should adopt
neutral practices. Chair Flint suggested that Orono has a lower profile than the City of
Minneapolis and the City need not stick its neck out to test the law.
ADJOLTLNMENT
It was moved by Howells, seconded by Vongries to adjoun. the meeting of the Park Commission
at 8:45 p.m. .Ayes 5, nays 0.
Richard N.
