The amendment reads <br />as follows: That point on the cross section of a bluff below which the slope becomes <br />more than 18% and above which the average slope for a distance of 50 ’ or more is 18% <br />or less. <br />List of Exhibits <br />A - Staff Memo 3/16/94 <br />B - Ordinance #126, 2nd Series <br />C - Sketch of New Building Envelope, Defined by Required <br />Setbacks from Lot Lines and Top of Bluff <br />D - Dimensions of Building Envelope <br />Status of Application <br />At the March 21st meeting of the Planning Commission, the application was tabled pending <br />resolve of the zoning amendment redefining top of bluff. The variance application is a part of <br />a comprehensive application involving a subdivision proposing a realignment of the lot lines of <br />applicant ’s homestead parcel and die contiguous undeveloped lot also owned by applicant. The <br />application for subdivision was conceptually reviewed by the Council and received unanimous <br />support. <br />The issue of the bluff impact and required setbacks from bluff were not addressed during the <br />subdivision review. In fact the bluff ordinance was not enforced or implemented until February <br />of this year. The code section has had a major impact on many of the lakeshore applications <br />considered by the City. The definition for the lop of bluff has been amended in an attempt to <br />make it less restrictive. <br />Members are asked to review Exhibits C and D. We had originally assumed the new definition <br />would allow for a simple visual interpretation of the top of the bluff. Major portions of the <br />building envelope have been defined from the 30 ’ setback at the 1010 elevation. At the 1010 <br />elevation the slope begins to revert to an 18% or less slope.
