r <br />•, <br />H- <br />- <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district: that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or otter danger to neighboring property: would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty: is necessary to preserve a substantial property <br />right of the applicant: and would be in teeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of tte CiQr. <br />5.Tte City Council has consideted this application inchidiog tte findings and <br />tecommendatioiis of tte Planning Commission, reports by CiQr staff, coirunents <br />by tte and tte effect of tte proposed variance on tte health, safety and <br />welfare of tte community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of tte above findings, tte Orono CiQf Council hereto <br />grants variances to Municipcl Zonirig Code Section 10.03, Subdivision 14 (C), Sectioo 10.22, <br />Subdiviskm 2, Section 10.25, Subdivision 6 (B) and Section 10.56, Subdivision 16 (C) (2) to <br />permit tte construction of a garage addition, a second story, and grade level addition involving <br />tte conversion of an 18* x 18.9* deck, 6.8* x 18* addition at tte southeast comer of residence <br />and an approximate 10* x 18* lakeside deck as shown on tte site plan included as P^ ge 6 of this <br />resolution, subject to tte following * <br />1 All land alterations resulting from tte proposed new constructioa shaU be subject <br />to standards set forth in Section 10.56, Subdivision 6 (B) governing erosion <br />control, preserving existing vegetatkm for tte screening of structures and otfier <br />facilities as viewed from tte surface of Lake Minnetonka. <br />2.Applkam shall complete all existing hardcover improvemems as shown on P^ <br />6 of this resolution prior to tte footing inqwctkm by tte Orono BuHdirtg <br />Department. Hardcover within tte 0-75* setl^k area shall be niamtained at <br />1,2139 s.f. or 14.7% and within tte 75-250* setback area at 3,557 s.f. or 43.1%. <br />3.Authorities granted by this resolution tun with tte property not with tte applic^. <br />but are penntssive only and must be exercised by applicatk>:!i for a buildi^ <br />permit within one year of tte date of Council approval, or this variance will <br />expire on that date (June 13, 1995). <br />Page 3 of 6 <br />1
