Zoning File 01936
June 14. 1994
Page 3
to the lakeside of the existing residence but to the location of the average lakeshore
setback line. This is why staff asked that the residence structures on either side of the
Troyak residence be shown on the survey.
The applicant also questioned why the City staff would have issued a building permit for
an addition on the same west side in 1988 never noting need for a setback variance. If
you would review Exhibits J and L. the residence to the west was not constructed at that
time. Suff only needed to consider the average lakeshore setback as it related to the
house to the east. If a line was drawn from the front line of both the Troyak structure
and the structure to the east, the proposed addition of 1988 would have had no impact.
There is no doubt that the existence of the house to the west has a major impact on the
Troyak property as far as it relates to the average lakeshore setback line.
As promised, staff will schedule the application before the June 27th meeting of the
Council in order to expedite the review of this application.
