The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other propert>’ in this zoning district; that <br />granting the variances would not adversely affci t traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring propert>-; would not merely <br />serv'e as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City statf, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.03, Subdivision 14 (C), Section 10.22, <br />Subdivision 2, Section 10.25, Subdivision 6 (B) and Section 10.56, Subdivision 16 (C) (2) to <br />permit the construction of a garage addition, a second story, and grade level addi.;o,i involving <br />the conversion of an 18 ’ x 18.9 ’ deck, 6.8 ’ x 18 ’ addition at the southeast comer of residence <br />and an approximate 10 ’ x 18 ’ lakeside deck as shown on the site plan included as Page 6 of this <br />resolution, subject to the following conditions: <br />1.All land alterations resulting from the proposed new construction shall be subject <br />to standards set forth in Section 10.56, Subdivision 6 (B) governing erosion <br />control, preserving existing vegetation for the screening of stmetures and other <br />facilities as viewed from the surface of Lake Mirmetonka. <br />Applicant shall complete all existing hardcover improvements as shown on Page <br />6 of this resolution prior to the footing inspection by the Orono Building <br />Department. Hardcover within the 0-75 ’ setback area shall be maintained at <br />1,2139 s.f. or 14.7% and within the 75-250 ’ setback area at 3,557 s.f. or 43.1%. <br />3.Authorities granted by this resolution run with the property not with the applicant, <br />but are permissive only and must be exercised by application for a buildiiig <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (June 13, 1995). <br />Page 3 of 6
