B. There is only one location on the entire 5 acre site that would support and <br />treat on-site sewage. <br />C. The 2 acre building site is severely limited by a bluff and steep slopes. <br />D. The e.xtreme drop from the elevation at the street to the west portion of <br />the dry buildable envelope are severe. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the varian;e would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not tnerely <br />serve as a conveiience to the applicant, but is necessary to alleviate a <br />demonstrable hardsl»T difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comp'-ehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the pionosed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER .\ND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />Grants a variance to Municipal Zoning Code Section 10.56, Sulxlivisions 16 (C 1) subject to the <br />following conditions: <br />1. Upon application for a building permit, applicant shall provide a detailed grading <br />and drainage plan that will adhere to the protective standards for construction <br />within the steep sloped areas. Erosion control must be maintained until <br />groundcover is restored. The plan must provide detail on imerceptor/French <br />drain to be installed to east and north drainfield areas. <br />2.Applicant must obtain a Hennepin County driveway permit before any work can <br />commence within right-of-way of County Road. <br />Page 2 of 4
