Zoning File #1918 <br />April 13. 1994 <br />Paee 2 <br />Wetland Encroachment <br />The driveway as rough-graded brings fill to the edge of the wetland as defined by a <br />952.0’ elevation contour. The City was granted a conservation and flowage easement over a <br />smaller wetland area as part of the 1978 subdivision, but review in 1987 indicated the wetland <br />was significantly more extensive. A new flowage and conservation easement incorporating the <br />enlarged wetland boundaries using the 952.0’ contour was granted in 1987. <br />Given the driveway base work in place, staff would suggest the following conditions for <br />renewal of this application: <br />• Prior to Council approval, applicants ’ surveyor to stake centerline of easement to <br />confirm driveway will be within said easement. <br />• No additional filling can be allowed at the point where driveway abuts edge of <br />wetland (about 50-100 ’ south of road). Filling in this area would likely require <br />MCWD. DNR and Corps of Engineers approval. <br />• Prior to review by Council, applicant to provide certified copy of driveway <br />easement over Lot 8. <br />• Applicants to provide certified copy of executed flowage and conservation <br />easement granted in 1987. <br />• Additional conditions of approval discussed in prior resolution: <br />a. <br />b. <br />c. <br />Since land alteration permit #00623 has expired, applicants ’ contractor <br />shall obtain a new land alteration permit for the driveway construction. <br />Applicants shall call for a final site inspection upon completion of the new <br />driveway. <br />The culvert at the drainageway crossing under the driveway shall be 24" <br />in diameter. <br />Applicant is advised to contact the Minnehaha Creek Watershed District <br />to confirm whether they will require any permits for the new driveway <br />construction and whether they are satisfied with the restoration work <br />completed in 1988 (no further restoration of the aborted driveway site will <br />be required by the City). <br />Staff Recommendation <br />Staff recommends approval per the conditions as noted above. <br />(■'
