Briefly, applicants request renewal <br />of the conditional use permit and variance for construction of a driveway which encroaches into <br />the 26* wetland setback but not into the wetland. The original approval was granted to a <br />previous owner :n 1987, who commenced driveway construction but never completed it and <br />never built a home on the site. <br />The applicants have submitted a building permit aoplication and plan to finish <br />construction of the driveway as previously approved. <br />Staff b'*' .conferred with the MCWD who will not require a permit since no additiorial <br />fill within thr wetland itself is proposed and since the original project was approved during the <br />time frame which qualifies it for a Wetland Conseivation Act exemption. <br />Staff Recommendation <br />Staff recon mends approval of a conditional use permit and variance for driveway <br />construction encroaching within the 26’ wetland setback zone for James K. and Julie Ann Lynch- <br />Daniels at 1225 Orono Oaks Drive per the attached resolution. <br />COUNCIL ACTION REQUESTED: <br />Adoption of attached resolution approving variance/CUP.
