BUCEY VARIANCE APPLICATION <br />4. <br />5. <br />1. Holzer's concrete block retaining walls are leaning outward <br />toward the neighbors* properties. <br />2. Also the way Holzer filled and graded his lot, water cones <br />over the top of the walls and around the ends of the walls <br />onto the neighbors' properties. <br />3. There should be drainage swales on the Buceys* side of the <br />property lines to carry the water streetward and lakeward <br />without it coining onto the neighbors' properties. <br />The Buceys should not cut down trees on the cliff down to <br />the lake on the Smerlings’ side of the property line. <br />The Buceys should not dump leaves over onto the steep cliff <br />as that kills the ground level vegetation and will set the <br />stage for mud slides in the future (as along Co. Rd. 15 in <br />Minnetonka Beach). Such slides can cause erosion slides on <br />the Smerling side of the property line as well as on the <br />Buceys* own land. <br />6. In general, the proposed improvements are too tall, too <br />massive and too close to the Smerling property for a lot the <br />size of the Bucey lot. The Smerlings* light, air and <br />privacy are compromised by the improvements. The zoning <br />ordinance standards are "minimums, ** which should be adhered <br />to, especially on small lots with small minimum standards. <br />Each neighbor is entitled to the benefit of the legal <br />minimums especially where no or few variances are needed if <br />the improvements are merely made slightly smaller. <br />7. The proposed new deck will be- in the Smerlings' west and <br />northwest views, and at a higher elevation due to the <br />filling Holzer did.
