Staff would suagest that controls over the shared <br />dock’s use would be best left to reviewing bodies more experienced <br />in such matters as the Marina Committee and the LMCD. <br />Please review the Plannina Commission minutes of August 15» 1983 <br />that approves Zuckman's conditional use permit by a 3 to 2 vote. <br />I would suggest that Council refer the conditions cloallng with <br />dock use to the Marina Committee for consideration. <br />RECOMMENDATION FOR COUNCIL ACTION <br />Approve a conditional use permit for Richard Zuckman and give <br />conceptual direction to st-ff to draft a resolution of approval <br />to include the following points! <br />a) Allow the units to remain subject to standards in code <br />for non-conforming uses/structures or establish reasonable <br />phasing out schedule for the seven units. Offer an incentive <br />for an early phase out (within 2-3 years) and give an <br />additional unit credit over allowed 2 (H acre per unit) <br />for l-*> acre site. <br />b) r.imit storaae of boats on land only - Ordinance 37.120 <br />allows boats less than 20 feet to be stored on property <br />if the storage of boats can meet specific performance <br />standards. This property cannot meet such performance <br />standards - Boat storage on land should be limited to no <br />more than three small fishing boats less than 1€ feet in <br />length - larger boats should bo stored off the property. <br />• <br />c) All building repairs should be reviewed by the Building <br />Department. <br />Parking of all cars must continue to be on <br />not on North Shore Drive. <br />the site and <br />e) Apolicant should continue to seek and employ other iMthoda <br />of reducing excessive hardcover. <br />'^4
