5. The City Council fircis that the conditions existing on this property arc peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic coraiitions. light, air not <br />pose a fire hazard or other danger to neighboring propeny; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code are! Comprehensive Plan of the City. <br />CONCLISIONS, ORDER AND CONDITIONS <br />Based upon the abos'e findings, the Orono City Council hereby grants a variance <br />to Municipal Zoning Code Section 10.03, Subdivision 9 (C-3) and Subdivision 9 (D) to allow <br />the proposed accessory structure to be located nearer the front lot line than the principal <br />building; and grants a variance to Section 10.03, Subdivision 9 (C) to allow the oversized <br />accessory structure a footprint of 1.800 s.f. where only 1,600 s.f. footprint would normally be <br />allowed, subject to the following conditions: <br />1. The oversized accessory structure shall be subject to the standard covenant <br />rec{uirements of Zoning Code Section 10.03, Subdivision 9 (C-3c). <br />2. Per applicant’s proposal, the exterior of the accessory building shall be finished <br />similarly to the existing residence structure. <br />3. The proposed accessory structure shall be located as proposed by the applicant on <br />the site plan atuched as Exhibit A. Any changes to this location which places the <br />structure nearer the west or north lot lines shall be subject to further review by <br />the Citv. <br />4. Authorities granted by this variance run with the property not with the <br />but are permissive only and must be exercised by application for a builuing <br />permit within one year of the date of Council approval, or this variaiKe will <br />expire on that date (May 9, 1995). <br />Page 3 of 5
