5. <br />B A rcsidctire Iiad existed on the prof *riy for over 40 years until it was <br />destroyed in a fire in 1989. <br />C.The size and width of the lot is consistent with otter properties within the <br />Highwood Road neighborhood. <br />D.The original residence was located 13’ from the street lot line and 3’ from <br />the west side lot line. <br />The new principal structure will be located 23’ from the street lot line and <br />a deck 14’ from the street lot line and 3’ from the west side lot line. <br />The City CouiKil Finds that the conditions existing on this property are pecuim <br />to it and do not apply generally to other property in this zoning district; that; <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or otter danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />right of the applicant; and would be in keeping with the spirit and intent ot the <br />Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comment <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants variances to Municipal Zoning Code Section 10.25.
