II. <br />12. <br />13. <br />The follow^’ig lots will be involved with wetlands created as compensation or <br />mitigation areas; <br />Dickey parcel - Lots 1-6, Block 1; Lots 1, 3, 5. 6, Block 2 <br />Coffin property - Lots 1, 2, 3, 5, 6, 7, 8 and 9, Block 1. <br />The developer shall create covenants to be filed on Chain of Titles of these <br />properties advising funire owners of the limitations on the use of these areas and <br />the need to first apply to the Corps of Engineers and the Watershed District if any <br />improvements are proposed at some future date before obtaining the necessary <br />permits from the City. Applicant shall provide mapping and metes and Inrands <br />description in order to complete covenants. <br />All wetlands designated on City conservation map shall be shown as drainage <br />easements on the plat. There are no designated wetlands within the Dickey <br />property. Lots 1, 2, 7, 8 and 9 of the first phase division of the Coffin property <br />have protected wetlands. <br />The subdivider has submitted a written request asking to amend the preliminary <br />plan of the Dickey property. They request that Outlot A, the park outloi, be <br />deleted from the first phase subdivision and to incorporate the park outlot in the <br />second phase division. The subdivider notes the uncertainty surrounding the <br />status of the site should be resolved before platting is finalized. <br />The internal trails within the Dickey property providing access to DNR park and <br />Luce Line shall be dedicated to the public. The internal trails within the Coffin <br />property shall remain private. The areas of the interior trails shall be excluded <br />from the lot areas of each adjacent or contiguous lot. The City shall not credit <br />the area of these trails against the park dedication fee. <br />A drainage easement shall be required over all retention ponding areas. Such <br />easements to be recorded in the Chain of Title. <br />Developer shall create covenants defining future homeowners association <br />responsibility for upkeep and maintenance of all drainage facilities. <br />Page 5 of 9
