G.”1iardson <br />Title Public Works Director <br />Administrator Reviewed;Agenda Section: <br />Public Works <br />Item Defcription; Prospect Road Closure Proposal <br />Rccemly the Park Commission as part of an overall review <br />recommended to Council to close Prospect Avenue from Brown Road (Co. Rd. 146) to Arbor <br />Street. <br />The Park Commission conducted i public information hearing on the matter wi»h very little <br />opposition on the part of the Crystal Bay residents. <br />Attached is a partial drawing of the Crystal Bay area showing three alternate entrance/exists to <br />use if Prospect is closed - Arbor Street to North Shore Drive, Briar Street to North Shore Drive <br />and Crystal Avenue to Brown Road South. <br />City Attorney Kevin Staunton has submitted his opinion on a simple council action versus a <br />formal vacating. <br />It is recommended that if the road is to be closed it be closed by council action versus a formal <br />vacation of the roadway. Because the City is the owner of property on both sides of the road <br />the City would receive ownership of the vacated road regardless without the expense of a fomal <br />vacation which requires a formal public hearing, a replatting of the area and the filing of t e <br />appropriate documents with Hennepin County Recorder. <br />Council Action Requested; <br />Motion regarding the closure of Prospect Avenue from Brown Road (Co. Rd. 146) to Arbor <br />Street.
