5. <br />6. <br />7. <br />9. <br />Concurrent with the creation of this private road, the subdividcr has dedicated to <br />the City a road and utility casement granting to the City permanent access, <br />improvement and utility easements over said outloi; the subdivider has created <br />non-exclusive ingress, egress, drainage and utility easements over said outlot in <br />favor of all abutting and/or benefitting lots including a declaration of covenants, <br />conditions, restrictions and private roadway easemem wherein any lot shall be <br />sold, transferred and conveyed together with an undivided 1/7 interest in said <br />road outlot whereby benefitting lot owners covenant and agree to permanently <br />maintain and pay the cost of maintenance for said private road. <br />The existing residence within Lot 8 shall maintain its driveway access directly to <br />Watertown Road. Lotts 1-7 shall be served by the private road outlot based on <br />the following findings: <br />Location of the garage serving the existing residence, and the layout of <br />existing buildings on the property, would result in the need to construct <br />a driveway 300’ in length and destroy certain trees and amenities of the <br />existing residence site. <br />b.The existing driveway location serving the existing residence accesses <br />Watertown Road at a location that is not hazardous based on venical or <br />horizontal site lines. <br />Dedication to the City of drainage easements providing for limitations on the use <br />of drainage retention areas and drainageways described therein a xl shown on the <br />plat as drainage easements. Owners of Lots 1-7 shall be responsible for regular <br />maintenance and repairs of drainage facilities. <br />Execution of a Developer ’s Agreement providing for the installation of certain <br />improvements as a condition of subdivision approval. Applicant shall provide to <br />the City a Letter of Credit in the amount of S6 1,650 (bas^ on 1994 costs) prior <br />to the installation of these improvements. <br />8. Payment to the City of a park dedication fee in the amount of $13,776 <br />Payment to the City for the legal review and filing of the plat, easements and <br />covenants in the amount of $200.00. <br />10.
