Mabusth, Building & Zoning Administrator <br />March 17, 1994 <br />SUBJECT: #1909 David and Margaret Vergeyle, 1485 Green Trees Road - Variance - <br />Public Hearing <br />Pertinent Ordinances <br />Section 10,56, Definition 2 Bluff - Topographic feature such as a hill, cliff or embankment <br />having the following characteristics (an area with an average slope of less tha». 18% over a <br />distance of 50 ’ or more shall not be considered part of the bluff): <br />A. Part or all of the feature is located in a shoreland area; <br />B. The slope rises at least 25’ above the ordinary high water level of the <br />water body; <br />C. The grade of the slope from the toe of the bluff to a point 25’ or more <br />above the ordinary high water level averages 30% or greater; and <br />D. The slope must drain toward the water body. <br />"Toe of the bluff" means the lower point of a 50 ’ segment with an average slope <br />exceeding 18%. "Top of the bluff" means the higher point of a 50 ’ segment with an <br />average slope exceeding 18%. <br />Definition 3 Bluff Impact Zone - A bluff and land located within 20’ from the top of a <br />bluff. <br />Defimtion 26 Steep Slope - Lands having average slopes of 18% or greater as measured <br />over horizontal distances of 50 ’ or more, that are not bluffs. <br />Section 10.56, Subd. 7, Classification of public waters - Recreational Development Lakes (RD) <br />Tanager Lake 929.4 <br />Section 10.56, Subd. 16(C-1) - Setbacks from shoreline required for structures = 100’ <br />Two additional structure setbacks: <br />Setback from top of bluff for structures = 30’ <br />Bluff impact zone,Slnicmres and accessory facilities except stairways, <br />landings and lock boxes must not be placed within bluff impact zone. <br />Section 10.56, Subd. 16(G) - Steep slopes. Any applicant requesting a permit for construction <br />of sewage treatment systems, roads, driveways, structures or other improvements on steep <br />slopes, shall provide adequate information to allow the City to evaluate possible soil erosion
