3.The Orono Planning Commission reviewed this application on March 21, 1994 <br />and recommended on a vote of 4 ayes, 2 nays and 1 abstention, conditional <br />approval of the propoad variances per the following findings and recommended <br />conditions: <br />A. This lot was platted in September of 1980 and was approved by the City <br />at 1.69 acres in area. <br />B. The property is not sewered, therefore an on-site sewage treatment system <br />is requi^. <br />C. The dry buildable portion of the lot that is not within the 100’ lakeshore <br />setback nor within the bluff impact zone, is surrounded by private <br />roadway on three sides and a 50’ street setback is required in the LR-IA <br />zone. <br />D. Once the lakeshore setback, setback from top of bluff, front and side yard <br />setbacks and setback from septic system are accounted for. the remaining <br />buildable area of the property is approximately 15’ x 65 ’, not large <br />enough for construction of a residence on the property. Therefore, <br />without approval of variances, the lot would be unbuildable. <br />The proposed location of the residence requires variances to both the 30’ <br />bluff setback and the prohibition on struemres within the bluff impact <br />zone. The proposed dwelling location in addition to proposed filling and <br />retaining walls approximately 30’ lakeward of the foundation would result <br />in the removal of a substantial number of mature trees and other <br />vegetation w ithin the bluff and on steep slopes, require a variance to the <br />prohibition on intensive vegetation clearing on steep slopes. <br />F. No hardship or need has been justified for granting of the variances <br />necessitated by the fill and retaining walls. <br />E. <br />Page 2 of 7
