5. <br />right of the applicants; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings aiKl <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (A) and 2 to permit <br />the construction of a 650 s.f. addition to the south side of the existing residence to be located <br />39’ from the channel shoreline and 50 ’6" from the Maxwell Bay shoreline resulting in a total <br />hardcover of 5,040 s.f. or 10.9%, subject to the following conditions: <br />1. <br />2. <br />3. <br />3. <br />4. <br />All hardcover scheduled for removal must be completed prior to the final <br />inspection for new construction by the Orono Building Inspector. <br />The area or footprint of the addition shall not exceed 650 s.f. of additional <br />hardcover. Overhangs on new addition are not allowed along the channel <br />shoreline side, 1 1/2 ’ along the Maxwell Bay shoreline side and 4 ’ along the west <br />side of the structure. <br />Authorities granted by this variance run with the property not with the applicants, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (March 14, 1995). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heirs, successors and assigns. <br />Page 3 of 5
