C. There is no adjacent lands available for af^licants to acquire. <br />D. Hardcover shall be maintained below 25% within the 75-250’ setback <br />area. <br />E. There are no hardcover improvements within the 0-75’ setback area. <br />F. The property is served by municipal sewer. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply ger^rally to otter property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessaiy to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5 The City Councd has considered this application including the findmgs and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants variances to Municipal Zoning Code Section 10.25, Subdivision 1 (B) and 2 to <br />permit the construction of a new residence structure on the property that consists of 13,894 s.f. <br />or .32 acres with a variance of 7,886 s.f. or 36% and a width variance of 57’ or 57%, subject <br />to the following conditions; <br />Hardcover within the 75-250’ setback area is proposed at 2,194 s.f. or 21.9%. <br />Applicant is advised that there is 300 s.f. for additional hardcover improvements. <br />Authorities granted by this resolution run with the property not with the <br />applicants, but are permissive only and must be exercised by application for a <br />building permit within one year of the date of Council approval, or this variance <br />will expire on that date (February 28, 1995). <br />1. <br />2. <br />Page 2 of 4
