CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to permit the <br />construction of an 8*x40 ’ entry addition at the south side of the existing residence resulting in <br />an increase of 69.3 s.f. or .5% hardcover where 4,792 s.f. or 35.1 % exists. Approval is subject <br />to the following conditions: <br />1. <br />2. <br />3. <br />4. <br />5. <br />6. <br />Applicants are advised that the City must approve all structural alterations or <br />improvements of second residential structure on property before a building permit <br />can be issued by the staff. <br />All hardcover removals as shown on page_of this resolution shall be completed <br />prior to June 1, 1994 or at tlie time of the final inspection by the Building <br />Inspector for new construction whichever comes first. All disturbed areas must <br />be restored with natural ground cover. <br />Applicants shall relocate oversized boat in a less conspicuous location on property <br />by the fall of 1994. Boat must not be stored within the right-of-way of the public <br />roadway. <br />Authorities granted by this variance run with the property not with the applicants, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (February 14, 1995). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of tliemselves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the <br />property. <br />Page 3 of 6
