Since the new ordinance amendment of the second series. Exhibit G, the barns that <br />will house animals for private use can be 75’ from the lot line. The <br />existing barn is located 37' from the residential used property to the west <br />and 110' to the school property to the south, review Exhibit H. Staff has <br />designated the 75' setback from the adjacent, lot lines in the area of the <br />barn. If a paddock is to be installed, the City would have to condition <br />approval on the paddock area being at least 75' from the existing <br />residential lot lines. Applicant has the opportunity to extend the paddock <br />area closer to the residence structure northward. <br />Staff has received no comments from either the school district or the <br />resident of 2905. Also note that the residence clearly meets the 150* <br />separation from the existing barn. The majority of area owned by the <br />school is vacant lands on the east and to the south is a football practice <br />field. <br />Per Section 10.20, Subdivision 3 M, when the horses are kept stabled and do <br />not require a pasture for feed purposes, the minimum pasture requirement <br />may be adjusted at the disgretion of the Council. It is this section that <br />the applicant wishes special consideration. Applicant will provide feed <br />and has no need for the additional pasture area for the feeding of two <br />horses. <br />Staff ReccamsendaticMi <br />To approve the minimum pasture requirement for the maintaining of two <br />horses at the residence located at 2885 6th Avenue North based on the <br />following finding: <br />1. Applicant will provide feed, thereby not requiring additional <br />pasture area. <br />2. The property has a barn in excellent condition. <br />3. There are no conditions setforth by City resolution that would <br />have prohibited the use of the barn for the housing of animals. <br />4. The City has received no comments from the affected neighbors <br />requesting that the City deny the applicant's variance application. <br />Approval is subject to the following conditions: <br />1. New paddock area must be installed 75' from east,south and west <br />lot lines. <br />2. Animals may be kept housed within this barn only for the <br />exclusive private use of the residents. <br />3. This approval limits the maintenance of horses to two.
