Toberman <br />Shelard Tower, Suite 1460 <br />Minneapolis, MN 55426 <br />Re: Resolution #2193 -/1960jShoreline Drive <br />Resolution #2194 - Shoreline Drive <br />Dear Mr. Toberman; <br />In regard to your request to extend the expiration dates of the <br />original land use applications approved for 1955 and 1960 Shoreline <br />Drive, the ordinances' of the City do not provide the City Council with <br />the authority to extend the expiration dates for an <br />undefined/limitless time period. The ordinance does allow the City <br />Council to extend an expiration date if an applicant requests so in <br />writing prior to the expiration of the variance or conditional use <br />permit approval, but only if that applicant can confirm to the City <br />that the approved use would begin within a short or reasonable period <br />of time. It would appear that the proposed uses of 1955 and 1960 <br />Shoreline Drive will not be realized for another six months to a year. <br />You may apply for a simple renewal variance applicacion for 1955 <br />Shoreline Drive at a half price of the original application and as <br />long as no changes are proposed from the original plans, the <br />application may be scheduled before both the Planning Commission and <br />Council as a consent item requiring no discussion. <br />In the case of 1960 Shoreline Drive, you may also apply for <br />renewal of the conditional use permit but note that the use as <br />approved under the original conditional use permit (Resolution #2193) <br />allowed only a legal non-conforming use for a boat sales/nautical <br />shop. If you propose another use, this would require a separate <br />conditional use permit review.
