Denial. If the current conditional use permit and <br />variance is to be denied, please refer to Section 10.08, <br />Subdivision 3 for the necessary findings. Please note <br />technically we are dealing with a variance to the non- <br />conforming use sections of the code. Refer also to Section <br />10.09, Subdivision 6 (A) for necessary findings for denial <br />of conditional use permit. Planning Commission should also <br />be prepared to provide directives for applicant as to the <br />phasing out of the non-conforming use to a conforming <br />residential use. <br />2. Approval of conditional use permit and variance. If <br />approved, please refer to the same code sections noted above <br />and to the specific findings addressed by staff above. <br />Approval should be conditioned on one or more of the <br />following conditions! <br />a) Repair of privacy fence. <br />b) Installation of gravel within median area and <br />general clean-up of most southern median area. <br />c) Install "No Parking" signs on east side of <br />building. <br />d) Security lighting shall be directed downward on <br />property and not out towards adjacent residential <br />properties. <br />e) Parking stalls to be striped on paved area. <br />f) The stacking of fishing boats for exterior sales <br />purposes shall be limited to 6* in height. <br />Upon approval, staff will work with Hennepin County <br />Department of Transportation to install crosswalk in approved <br />location.
