Ronald Gartner <br />1254 Loma Linda Avenue <br />P4ound, Minnesota 55364 <br />Dear Mr. Gartner: <br />In response to your request asking <br />private dock on public property or <br />the City of Orono install a publ:i c <br />public street located between 1250 <br />the following information: <br />i.f you could install your <br />if this is not allowed, would <br />dock on the platted undeveloped <br />and 1260 Spruce Place, I offer <br />The public street that provides access to North Arm is 40 feet in <br />width. It is public property and cannot be used for construction <br />or maintenance of private docks. <br />In considering your request to construct a public dock at this <br />location, we have reviewed the history of the area and the site <br />to determine the rationale for a City dock at this location. <br />The past history reveals that a public dock has not been utilized <br />at this location because of the natural grade to the lake, where <br />persons could walk to without undue hardship. <br />I understand from the neighbors in the area that individuals have <br />installed their own docks at this location, which is not permissible <br />because of the liability to the City. <br />Because of the gradual slope to the lake and the natural shoreline, <br />the construction of a City dock would only encourage storage of <br />boats or other private property that is not allowed at 'these locationse <br />Since the area is not maintained as a street to the lake, a dock <br />would only encourage excessive use in an area that is not prepared <br />for any other uses except to allow foot traffic to the lake. <br />There are locations that are prepared for dock construction, one <br />which is located approximately three blocks from your residence, <br />which is a gravelled lake access to North Arm on Loma Linda Avenue. <br />
