p.AT^ CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />1. <br />i\j111L- <br />G NO. 7396 <br />t'. <br />kEs Homo''' <br />A RESOLUTION <br />AMENDING RESOLUTION NO. 7382 <br />WHICH GRANTS A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-420 <br />FILE NO. LA23-000024 <br />WHEREAS, on May 16, 2023, Kevin Revering and Sarah Revering, a married couple, <br />hereinafter the"Applicants"), applied for a variance from the City Code for the property addressed <br />1960 Fox Ridge Road and legally described as: <br />Lot 7, Block 1, Fox Ridge, Hennepin County, Minnesota (hereinafter the"Property"); <br />WHEREAS, on July 10, 2023 via Resolution No. 7382, the Applicants received approval <br />of a front yard setback variance from Orono Municipal Zoning Code Section 78-420 to allow a <br />garage addition 46 feet from the front property line where a 50-foot setback is required and a <br />56.9-foot setback currently exists; and <br />WHEREAS, the Applicants have requested an amendment to Resolution No. 7382 <br />regarding a minor modification to the approved plans reflecting a setback of 44.9 feet from the <br />lot line where a 46-foot setback was previously approved; <br />WHEREAS, The Applicants' proposed addition did not change dimensions or location, <br />however an annotated site plan was submitted for the variance approval. The updated survey <br />more accurately depicts the property lines and setback to-scale; and <br />WHEREAS, the City Council's decision was based on the findings and recommendation <br />of the Planning Commission, reports by City staff, comments from the Applicant and the public, <br />and the effect of the proposed variance on the health, safety, and welfare of the community as <br />well as the impact on the properties in the vicinity. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the amended plans attached as Exhibit A. <br />CONCLUSIONS, ORDER AND CONDITIONS: <br />C1.The original approvals granted with Resolution No. 7382 remain in place. The approved <br />project shall conform to the attached, revised plans submitted by the Applicants and <br />annotated by City staff, attached to this Resolution as Exhibits A & B. <br />1
