Zoning File #1420 June 14, 1989 Page 4 of 6 <br />7.In 1975, Earl Norwood requested and was granted variances to <br />front and side setbacks to construct a detached garage on <br />the property. The City granted variance approval subject to <br />legal combination of the 4 individual tax parcels, so that <br />the detached garage would be on the same parcel as principal <br />structure per the r'iquirements of the zoning code (Section <br />10.03, Subdivision 9). The configuration of the 4 <br />individual tax parcels was such that all 4 had to be <br />combined together in order to place the garage on the same <br />parcel as the house. Council minutes from November 24, 1975 <br />indicate Zoning Administrator Henry Munich had discussed the <br />substandard status of the 4 parcels with Norwood, and <br />Norwood agreed to the combination if the variances were <br />approved. <br />In August 1976, Norwood requested a further variance to <br />approve an accessory structure area variance of 176 s.f. to <br />make the proposed detached garage 1,176 s.f. total. That <br />variance was granted on the basis that the individual <br />parcels had been combined. That combination occurred in <br />July 1976. <br />8. Lot 2 as proposed will have no legal lake access <br />Discussion - <br />Staff has been unable to find evidence and is unaware of any <br />past City approval of similar requests to divide previously <br />c oined substandard lots to create substandard building sites. <br />The most similar application found is that of Duane Fall at 1860 <br />Shadywood Road, where a legal combination of 2 parcels totaling <br />0.9 acres in a 1/2 acre zone was denied a subdivision request for <br />a number of reasons including the creation of substandard <br />building sites from a conforming lot. <br />The resolution denying Hall's variance stated that, if the <br />requested multiple variances to lot standards were granted. <br />Council would abandon a long-standing established policy in the <br />review of subdivision applications and would establish an adverse <br />precedent for the future in similar applications. In addition, <br />the resolution noted that the City Council has not granted <br />variances to the minimum lot area or width standards with <br />subdivisions that create new building sites since adoption of the <br />current zoning code in January 1975.
