Also, <br />the Subdivider shall be liable to the City for any deficiency and <br />the City shall pay to the Subdivider any overplus arising from <br />payment based on an estimate. Also, if any payment is not made by <br />Subdivider pursuant to paragraph 6C, the City, at its option, may <br />refuse to give a building permit to any property transferred on <br />which the assessments have not been paid. <br />E. Waiver of Assessment Appeal. Execution of this <br />Subdivider's agreement by Subdivider shall constitute Subdivider's <br />formal agreement to the assessment agreement and formula as set <br />forth in this paragraph 6, including all subparagraphs, and in <br />Exhibit F attached hereto. Subdivider further agrees to waive, and <br />hereby does waive any and all rights to appeal from the special <br />assessment, including any supplemental assessment, as set forth <br />herein, including but not limited to, any procedural or substantive <br />rights, right to public hearing, right to any notice, pursuant to <br />Minnesota Statutes, Chapter 429, or any other ordinance of the <br />City, constitution, or law of the State of Minnesota or the United <br />States. <br />7. Services to be Performed bv City and Payment Therefor. <br />A. Plan A Improvements.
