LA23-000050 <br /> WHEREAS,John McGary with Lucid Builders(hereinafter the"Applicant"),applied for variances <br /> from the City Code for the property addressed 3359 Crystal Bay Road and legally described as: <br /> Lot 12, Wallace's Addition to the Village of Minnetonka Beach,Hennepin County,Minnesota <br /> (hereinafter the"Property"); <br /> WHEREAS,the Applicant has applied to the City of Orono for variances from City Code <br /> Section 78-350 for lot area and lot width to allow the construction of a new home;and <br /> WHEREAS,the Applicant has applied to the City of Orono for variances from City Code <br /> Section 78-350 for rear yard setback to allow the construction of a new home; and <br /> WHEREAS,the Applicant has applied to the City of Orono for variances from City Code <br /> Section 78-1279 to allow the construction of a new home within a required lake setback; and <br /> WHEREAS,the Applicant has applied to the City of Orono for a hardcover variance from City <br /> Code Section 78-1680 in order to construct a new home and hardcover within a required lake setback; and <br /> WHEREAS,the Applicant has applied to the City of Orono for a hardcover variance from City <br /> Code Section 78-1680 in order to exceed the hardcover limitation of 25%; and <br /> WHEREAS,on October 16,2023,after published and mailed notice in accordance with Minnesota <br /> Statutes and the City Code,the Planning Commission held a public hearing,at which time all persons <br /> desiring to be heard concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS,on October 16,2023,the Planning Commission voted 6 to 0 in favor of a motion to <br /> recommend approval of the variances as applied; and <br /> WHEREAS,on November 13,2023 the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> 1 <br />
