VACATE "HILLSIDE PLACE <br />My name is Jim Ogland and I live at 3345 Crystal Bay Road and <br />this is Don Stoyke my neighbor who lives at 3339 Crystal Bay <br />Road. We are here together requesting the vacation of a portion <br />of this lane. <br />As you know these lanes were originally platted as "fire lanes" <br />thereby providing access to lake water in the event cf a fire. <br />With the advent of city water mains and nearby fire hydrants <br />their original use has long ago become obsolete. <br />My parents and myself have owned and lived at this location <br />for almost fifty years. During this time we have maintained <br />and used this fire lane more or less as a part of our yard. <br />It blends right in and is indistinguishable. <br />The houses and lots here are quite small and very close together. <br />By vacating this parcel it would allow both lots to core conform <br />with todays zoning and land use requirements. It also would <br />eliminate title concerns and other problems for present and <br />future owners. The way it is now its use is vague and more <br />or less an encumbrance on both of our properties. <br />The land is uphill, quite steep and has several mature trees <br />growing on it. The railroad track at the rear of the property <br />is a natural divider and isolates us from other properties on <br />the other side of the tracks. <br />It seems appropriate that with the limited use potential that <br />this parcel has and that we are willing to accept and maintain <br />it, we ask that it be vacated and revert to the adjacent property <br />owners. <br />Orono Public Works Director John Gerhardson with whoc we have <br />met twice on-site, has indicated that he has no objection to <br />vacating this parcel subject to utility easements. <br />I might add that we have spoken with all of our closest neighbors <br />(many of whom are here tonight) and they are all in complete <br />agreement with our request.
