I <br />3 <br />city of Orono <br />Post Office Box 66 <br />Crystal Bay, MN 55323 <br />September 21, 1993 <br />Subject: Vacate twenty five foot lane at 3345 S 3339 <br />Crystal Bay Road <br />To whom it may concern: <br />We are requesting that the twenty five foot lane between 3345 <br />and 3339 Crystal Bay Road be vacated with one half of the parcel <br />reverting to each of the adjacent property owners. <br />The parcel is located between lots 8 and 9 and is bordered on <br />the north by Crystal Bay Road and the Burlington Northern <br />Railroad tracks on the south. <br />My family has owned and lived at 3345 Crystal Bay Road for the <br />past 47 years and during these years have used and maintained <br />this parcel of land as if it were their own. In almost fifty <br />years it has remained virtually untouched and unchanged. The <br />terrain is hilly, from Crystal Bay Road it is uphill and quite <br />steep. It is sandwiched in very closely between the existing <br />homes, (only nine inches from the SW corner of the house at <br />3339) and has several large mature trees on it. <br />Similar lanes were originally platted throughout Orono for use <br />as fire access lanes to provide lake water in the event of a <br />fire. With the advent of water available from strateg <br />ically located fire hydrants they have long since become obsol <br />ete for their intended purpose. <br />Vacating this lane is something that probably should have been <br />requested years ago when two others nearby on Crystal Bay Road <br />were vacated. Because of the steep terrain and proximity to <br />existing homes its best use is by these adjacent property owners. <br />Vacating the lane at this time would resolve a number of things. <br />It would allow both lots to conform more with todays zoning <br />and land use requirements. It would relieve anxiety by both <br />property owners as to uncertain future use. It would eliminate <br />title concerns and problems for other owners, and importantly, <br />it would put the property back on the tax rolls. <br />We hope that this request will be approved. <br />Sincerely, <br />James W, Ogland <br />James W.
