The applicant is requesting that the striping not be required and the fire lane <br />eliminated. <br />Authority for Fire Lane Requirement <br />The City adopted the State Fire Code in July 1979, and adopted Ordinance #237 <br />providing for the establishment and regulation of fire lanes, in May 1981. Those ordinances <br />were recodified as Section 9.34 of the Municipal Code in April 1984. <br />Section 9.34, Subdivision 1 officially adopts the Minnesota Uniform Fire Code. <br />Subdivision 4 provides that enforcement of the code is granted to and may be exercised by any <br />or all of the following: <br />A. Minnesota State Fire Marshal or his representative <br />B. Chief of the Fire Department contracted to serve a given area <br />C. Chief of the Orono Police Depanment or his officers <br />The Orono Building Official or his representative. <br />In their June 10, 1987 memo regarding this commercial site, Orono Building Official <br />Thomas Jacobs and Building and Zoning Administrator Jeanne Mabusth indicated that fire lanes <br />must be posted on the entire north side of the convenience center. The plan apparently was <br />subsequently revised to show a fire lane approximately 64’ in length, 14’ deep between the <br />convenience store and the pump island. That plan showing the fire lane was approved by the <br />City Council. <br />The State Fire Code indicates Uiat appeals to a fire code requirement shall be made to <br />the local "Board of Appeals" and/or "local governing body" before they may be acted on by the <br />State Fire Marshal. In this case, the Planning Commission is acting as Board of Appeals, and <br />the City Council is the local governing body. <br />City Rationale for Requiring Fire Lane <br />1. The Fire Code requires unobstructed view of self-service pumps to the employee <br />work station in the building that monitors the pumps. <br />The fire lane provides an access corridor for emergency vehicles. <br />t <br />I
