His father owned both tracts of land, erected <br />a fence and later discovered the fence at the back edge encroached up >n the adjoining lot by at <br />least 15’. In the early ’70s, an attorney was hired to correct the leeal descriptions by adding <br />the 15’ piece of land to Parcel C. Parcel A, where the Wheelers arc now living, was first sold <br />in 1976. His father passed away in 1980 and nothing iirrs been di'iie with the fence. It seemed <br />apparent that the City did not require approval back in 1971. He does not have a problem with <br />the either the present proposal or the addition of 1 1/2’ to the line. <br />Smith questioned if the two mature oak trees would be affected. <br />Barrett stated that the trees would not be impacted. <br />Chair Schroeder said without Mr. Wheeler present the 10’ setback issue cannot be addressed. <br />It was moved by Chair Schroeder. .seconded by Peterson, to recommend approval of Application <br />#1847 for Michael and Dana Barrett and James and Molly Wheeler, 2912 and 2918 Casco Point <br />Road, for subdivision of a lot line rearrangement and that Parcel B legally combine with Parcel <br />C so that tax records and the county plat maps can be corrected and grant the setback variance <br />as proposed. LUND, III, <br />905 TONKAVVA ROAD - VACATION OF SEWER EASEMENT - <br />PUBLIC HEARING 8:14 TO 8:17 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />Tres Lund was present. <br />Mabusth explained that applicants were fulfilling a condition of preliminary subdivision approval <br />by completing the vacation of a 20’ sewer utility ea.sement. The future residence will be served <br />by a sewer line located in the County Road. The existing residence is served by a line at <br />southeast lot line. <br />Smith inquired if the shed had been removed. <br />Lund answered ves.
