Code Sections 10.20 Subdivision 3 O and M. <br />B. Caffron Memo of 1/22/87 <br />The rcning code was acaended in February of '87 providing separate <br />standard for non-rental guest apartments. The previous code only <br />dealt with guest house use and standards for that use. Standards <br />established for the guest house were not functional cr appropriate <br />for guest apartawnts. Review Gaffron's memo, Exhibit B. providing <br />J)jjckgrcund on the general issues and the intent of the awendment. <br />Council's request resulted from the nany variances granted within <br />the last half year to tnia specific code section, the issue of <br />internal access. One of the conditional use applications involved <br />an internal access variance for a non-rental caretaker apartment <br />that existed for 37 years when the apartment was slated for major <br />remodeling. Access to that unit was from a single exterior door <br />not connected to principal residence but an attached garage. <br />Another dealt with an arartment unit that wao located on the second <br />floor of a garage connected by a skyway. Internal access was <br />provided via the skyway and a separate grade level entrance door to <br />the garage. In that case, the applicants requested special <br />consideration as one parent was in the early stages of alzheimer e <br />disease. In another conditional use permit application involving <br />a variance to internal accecs, the apartment was 1,000 s.f. in area <br />containing two bedrooms located above a i 1/2 stall garage. <br />Internal access was through an auxiliary door adjacent to garage <br />gtjTjcture entering in a mud room area off of a utility loom. The <br />access stairs at *'he upper level would have entered the master <br />bedroom through a closet area. Special consideration was eoucht as <br />applicant's son was a diabetic. <br />The internal access standard was developed to ensure that the <br />apartments could never be used for rental because access was <br />internal through th*' residence. The majority of conditional use <br />permits for non-rental apartments have been able to satisfy the <br />internal access standard. Staff will be happy to review the many <br />applications where non-rental apartment standards were completely <br />satisfled. <br />Review the material and if we have time at your meeting we may <br />discuss or you may prefer delaying until one of your workshops.
